These terms govern your use of clearproviders.com (the "site"), operated by Kitzer, LLC, 82 Nassau St #60540, New York, NY 10038 ("ClearProviders", "we", "us"). By using the site you agree to them. If you don't agree, don't use the site.

Prices are information, not quotes

Prices on ClearProviders come from public sources, such as hospital price files, provider websites and booking sites, or are entered by providers. They may be out of date, incomplete or wrong. They are not offers, quotes or guarantees. The price you pay is set by the provider. Always confirm the price, and what it includes, with the provider before you receive care.

Not medical advice, not insurance

ClearProviders does not provide medical advice, diagnosis or treatment, and does not recommend any provider. Choosing a provider is your decision. In an emergency, call 911. ClearProviders is not insurance and is not a health plan.

Who may use the site

You must be at least 18, or use the site with a parent or guardian.

Acceptable use and no scraping

You may use the site for your own personal, non-commercial research about healthcare prices. You may not, and may not help others to:

• scrape, crawl, harvest or copy prices or other content from the site by automated means, including bots, scripts, headless browsers or browser extensions. Search engines that follow our robots.txt, for the purpose of indexing, are the exception;
• build or contribute to a database, data set, product or service using our content;
• get around our usage limits, security challenges or access controls, for example by rotating IP addresses or devices or by using proxies;
• access the site's internal interfaces other than through our pages;
• interfere with or overload the site, or test its security without our written permission.

We use technical measures to enforce these rules, including device fingerprinting, usage limits, challenges and decoy data (see our Privacy Policy). We may block access and take legal action for violations. Decoy entries in our data are not real and may identify copied data.

Our content

The site's design, text, labels, compilations and data selections are owned by Kitzer, LLC or its licensors. Prices themselves may come from public sources, but our selection, arrangement and labels are protected. You may share links to pages and quote individual prices for personal or news purposes, with attribution.

Provider accounts

If you claim a provider page:

• you confirm you work at the practice and are authorized to act for it;
• you will keep its information accurate.

Prices you enter are shown as "Confirmed by provider". We may verify claims by email, phone or document review. We may also review, edit or remove content and suspend accounts that give false information. Providers who join ClearProviders Direct also agree to the Provider Participation Agreement. ClearProviders never charges providers to be listed.

Employer and member portals

Employer, member and point-of-care portals have their own agreements and privacy notices, which apply in addition to these terms.

Third-party links

Links to provider and booking sites are for convenience. We are not responsible for their content, prices or services.

Disclaimers

The site is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

Limitation of liability

To the extent the law allows, ClearProviders is not liable for any indirect, incidental, special or consequential damages arising from your use of the site. It is also not liable for any amount above $100.

Indemnity

If you misuse the site or break these terms, you will cover our reasonable costs of third-party claims that result.

Changes

We may update these terms. We will post the new version here and change the date above. Continued use after changes means you accept them.

Law and disputes

These terms are governed by the laws of the State of New York. Disputes will be heard in the state or federal courts in New York County, New York, except that either party may bring an individual claim in small claims court. If any part of these terms is unenforceable, the rest still applies.
